Terms of Service
Effective date: January 1, 2026
These Terms of Service ("Terms") govern your use of the RoadGofer platform and services (the "Service") operated by RoadGofer ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years of age and operating as a legitimate business entity to use RoadGofer. By registering, you represent that you meet these requirements. We reserve the right to verify your identity and business credentials at any time.
2. Account Registration
To use RoadGofer, you must create an account and provide accurate, complete information including a valid government-issued ID. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at hello@roadgofer.com of any unauthorized use of your account.
3. The Service
RoadGofer provides an on-demand delivery dispatch platform that connects businesses with drivers for the pickup and delivery of goods. We do not guarantee availability of drivers at any specific time. Delivery times and pricing are estimates and may vary based on distance, cargo type, and demand.
4. Acceptable Use
You agree not to use RoadGofer to transport:
- Illegal goods or controlled substances
- Firearms, ammunition, or explosive materials without proper licensing
- Hazardous materials (HAZMAT) not disclosed at the time of booking
- Live animals
- Human remains
- Any item that is illegal to transport under federal, state, or local law
Violation of this section may result in immediate account termination and may be reported to law enforcement.
5. Payment
All payments are processed securely through Stripe, Inc. By providing payment information, you authorize us to charge the payment method on file for all orders placed through your account. All prices are displayed before confirmation. We reserve the right to update pricing with reasonable notice. Charges are non-refundable except as described in our Refund Policy.
6. Driver Conduct and Chain of Custody
All RoadGofer drivers are required to maintain a valid driver's license, appropriate insurance, and to comply with all applicable laws. RoadGofer is not responsible for driver conduct beyond standard delivery services. Drivers may refuse deliveries they have reason to believe involve illegal goods. You agree to cooperate with chain-of-custody protocols including providing accurate pickup details and being available to confirm receipt.
7. Liability Limitations
RoadGofer is a technology platform and is not a licensed carrier or freight broker. We are not liable for:
- Loss or damage to goods during transport exceeding the declared value
- Delays caused by traffic, weather, or circumstances beyond our control
- Consequential or indirect damages arising from use of the Service
Our maximum liability for any single delivery shall not exceed the delivery fee charged for that order. You are responsible for adequately insuring high-value goods.
8. Dispute Resolution
Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration under the rules of the American Arbitration Association, in Chattanooga, Tennessee, rather than in court. You waive any right to participate in a class action lawsuit or class-wide arbitration.
9. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct we deem harmful to other users or to RoadGofer. You may terminate your account at any time by contacting us at hello@roadgofer.com.
10. Governing Law
These Terms are governed by the laws of the State of Tennessee without regard to conflict of law principles.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Service after the effective date of changes constitutes your acceptance.
